Terms and Conditions

 Section 1. General principles

a. Definitions

  1. The Conference - The National Estate Sale Conference organized on January 27, 28, 29, 2020, in Nashville, TN.

  2. Organizer - EstateSales.NET, having its registered address at 100 S High St. Jackson, MO 63755.

  3. Seller - EstateSales.NET, having its registered address at 100 S High St. Jackson, MO 63755.

  4. Registration system, hereinafter referred to as Attendify - An Internet application, owned by Attendify, which enables the supporting of the registering process for participants of the Conference.

  5. User - Every person that uses Attendify to register for the Conference.

  6. Participant - Persons who are 18 years old and have full capacity to perform acts in law, as well as legal persons and organisational units that do not have legal personality, but which are able to acquire rights and assume obligations in their own name, and which used Attendify to correctly register for the Conference, until January 29, 2020.

  7. Stripe - The credit card processing system we the Organizer uses to handle payment for conference tickets. 

  8. Signing of contract - The moment of submitting the fee for participating in the Conference to the Seller’s Stripe account. At this moment it is considered that the User has signed a purchase-sale agreement with the Seller, concerning the right to participate in the Conference. The acquiring of the right shall be confirmed by an email that includes an invoice.

  9. Participation fee - The amount determined by the Organizer that must be paid by Participants, so as to confirm their participation in the Conference.

  10. Payer - A paid Participant.

  11. Conference App - is the mobile and web-based application Conference Participants will use to access information about conference activities while attending the conference.  

b. Additional provisions and information

  1. The official Conference website is: https://www.estatesaleconference.com/,

  2. The scope of Attendify’s operation also includes a service that includes the storing of User registrations in a database, and handling such registration, by the Organizer and/or Seller.

  3. The technical requirements regarding the use of Attendify are not much different from the technical requirements concerning the use of the Internet. The User must have a computer with Internet access, as well as software that enables viewing of its contents. It is recommended to use the latest versions of the following browsers: Google Chrome or Mozilla Firefox.

  4. The provisions contained in these terms and conditions constitute an integral part of attending the Conference and are applicable to all Participants.


Section 2. Terms and conditions of participation:

a. To participate in the Conference Participants must:

  1. Register for the Conference, which can be done via an online form available at the Conference’s website; or via phone at 1-888-653-8468

  2. Pay the Conference fee, as defined by the Organizer under Art. 3 hereunder.

b. The Organizer reserves the right to modify the list of speakers and/or the agenda for reasons beyond its control. The Organizer shall not be held liable in any way for damages the Participants incur in such event.

c. The Organizer reserves the right to alter the Conference date for reasons beyond its control. In such event, Participants shall have a right to cancel their participation with a full refund. The Organizer shall not be responsible for covering any additional expenses of the Participants made in association with the Conference.

d. The number of Conference tickets is limited. Tickets will be available to Participants on a first come first serve basis.


Section 3. On-line Conference registration

a. Participants can only register for the Conference via an on-line form available at the address: https://www.estatesaleconference.com/registration/#registration-form or via telephone at the phone number: 1-888-653-8468. 

b. The Conference shall be open for registration from July 22, 2019 until the last available place has been booked, but in any case no longer than until January 29, 2020.

c. During their registration process, participants must fill all fields marked (*).

d. Participants thereby guarantee that all the details filled in are correct.

e. Participants must register for Conference workshops for an additional fee only if they wish to attend during the pre-conference workshop day on January 27, 2020. Each additional workshop is $150 and is not included in the price of the Conference ticket. This is an add-on experience and can be purchased through Attendify while purchasing the Conference ticket.

f. When the registration form has been filled in and the data confirmed, the system sends a message to the email address provided in the form, thus confirming the registration. Paid Participants will receive a receipt alongside the confirming email message.

g. Participation in the Conference shall be paid and shall include: One ticket to the National Estate Sale Conference for the days of January 28 - January 29, 2020.  Breakfast and lunch will be provided each day, along with a ticket to the January 29, 2020 Conference Reception.



Section 4. Settlement

a. The Conference fee shall be $999 unless otherwise listed at a discounted rate until January 29, 2020. 

b. The Seller provides for the following type of settlement:

  1. Using Visa, MasterCard, American Express or Discover credit cards available via the Stripe payment platform integrated with the registration system.

c. The Payer shall receive a receipt, sent electronically to the email address specified during registration, within 5 days following positive authorization of the transaction, via email.

d. When buying participation in the Conference, for the benefit of a third party, the Payer confirms that they have been authorized by such party to issue all the necessary declarations, as required to meet the requirements set forth herein. The person registering for the Conference and accepting its terms and conditions thus declares to be duly authorized to make financial commitments towards the Conference Organizer on pain of civil liability, including for damages, for lack or abuse of power.

e. When resigning from participating in the Conference, send a request for reimbursement of the cost of the Participation fee to support@EstateSales.NET. The Seller reserves the right to reject such request if the conference commences in less than seven calendar days.

f. Should such request be granted, the Seller shall return the fee, less the costs of returning the fee in the cheapest available manner, within 60 days of sending the request to the Seller.

g. The Participation fee referred to in section 1 of this paragraph does not include the following costs: Workshop attendance fees, hotel accommodations, travel fees, and additional reception guest attendance fees.


Section 5. Permission to use image

a. During the Conference, the Organizer may arrange photo sessions and may film the course of the Conference for the purposes of broadcasting in the media (TV, radio, Internet, press) or for the purposes of documentation, marketing, or advertising for the Organizer or other parties named by the Organizer. By participating in the Conference, Participants give their implicit permission for the recording, use an/or dissemination by the Organizer, parties related to it of each Participant’s image, voice, expression in any promotional and marketing materials without limitation of time or territory.

b. This permission means specifically that photo, video and audio recordings taken during the Conference may be placed on the Conference website or another website managed by the Organizer, as well as used in marketing materials, including by dissemination in audio or video formats. The Participants hereby waive any claims (existing or future), including for compensation from the Organizer for such use of their image, voice or expression for the purposes defined hereunder.


Section 6. General

a. The Organizer shall act as the administrator of personal data of the Participants and Payers.

b. The Organizer has entrusted, under a separate contract, the processing of personal data of the Participants and Payers to Attendify and Stripe for the purposes of the financial settlement of Conference participation.

c. Personal data of the Participants collected by the Organizer from the Conference participation form shall be processed for the Conference organization purposes in accordance with the terms and conditions.

d. Participants first name will be shared via the Conference app. At the Participants discretion, they have the ability to share their company position, website, company name, location, email, bio, phone, and profile picture with other conference participants via their personal Attendify profile.

e. The Organizer reserves the right to use the email address specified when registering for the Conference to send notifications to Participants of the Conference, including about changes in the Conference program or the terms and conditions.

f. Disclosure Practices. Except under the following categories of circumstances, the Organizer will keep your Personal Information private, and will not share it with third parties.

  1. Disclosure in Connection with Service.
    The Organizer discloses Personal Information to those who help it provide services, including without limitation those who perform technical, administrative, and data processing tasks such as hosting, billing, customer support, marketing, fulfillment, data storage, printing, and security.

  2. By Law or to Protect Rights. The Organizer discloses Personal Information when required to do so by law, in response to a subpoena or court order, or when the Organizer believes in its sole discretion that disclosure is reasonably necessary to protect the property or rights of the Organizer, third parties, or the public.

g. The Participants are required to observe and follow the Conference venue’s rules and policies, including principles of general safety, fire safety, and security.

h. During the Conference, the Participants shall follow any housekeeping instructions that may be given by the Organizer and in particular shall refrain from recording the conference in audio or video formats.

i. Should a Participant be found to be in breach of the Conference terms and conditions, the Organizer shall have a right to refuse the Participant the right to participate in the Conference and request him or her to leave the Conference site or venue.

j. The Conference has a limited number of places for participants. The Organizer reserves the right to reject registration requests when the limit is reached or at Organizers discretion.

k. The Main Conference ticket must be purchased in order to purchase workshop tickets and attend the conference workshops.

l. The Organizer reserves the right to make changes to these terms and conditions. Upon an announcement by the Organizer of any changes to the terms and conditions, each Participant registered for the Conference should immediately read such changes. Participants who do not accept any of the changes should notify of their position to the Organizer in writing via electronic channels at support@EstateSales.NET. The notification should reach the Organizer within 7 days from the entering into force of such changed terms and conditions in failure of which the Organizer shall regard the changed terms and conditions to have been fully accepted by the Participants.

m. The Organizer can be contacted via mail at 100 S High St. Jackson, MO 63755 or via email at support@EstateSales.NET.

n. Any disputes arising in relation to the Conference participation shall be decided by binding arbitration. Any Claim shall be settled by arbitration administered by the AAA in accordance with its Commercial Arbitration Rules, which are available at the AAA website https://www.adr.org/aaa/faces/rules, or by calling the AAA at 1-800-778-7879. Judgment on the arbitrator's award may be entered in any Court of Competent Jurisdiction. Claims shall be heard by a single arbitrator. The place of arbitration shall be Jackson, Missouri. Hearings will take place pursuant to the standard procedures of the Commercial Arbitration Rules that contemplate in-person hearings. The prevailing party shall be entitled to an award of reasonable attorney fees. The award of the arbitrator shall be accompanied by a reasoned opinion. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties. Your rights will be determined by a neutral arbitrator, and not by a judge or jury, and the arbitrator shall determine all issues regarding the arbitrability of the Claims. The one exception to this exclusivity of arbitration is that you have the right to bring an individual claim against Organizer in a small-claims court of competent jurisdiction. All legal proceedings, whether in arbitration or small-claims court, shall be governed by the laws of Missouri. You are responsible for paying your portion of the fees set forth in the AAA's fee schedule for any arbitration, and Organizer will pay all remaining fees, however, if your claim is for less than $1,000, Organizer will pay all fees. If you believe you cannot afford the AAA's fee, you may apply to the AAA for a fee waiver.

o. The Organizers shall not be liable whatsoever for the Participants’ property that may be lost, destroyed or stolen during the Conference. It is the Participants’ responsibility to arrange insurance coverage for during their conference attendance.

p. The Participants shall be fully liable for any damage they cause both in the venues involved in any Conference activities and in their accommodation.

q. By registering, Participants accept these terms and conditions.
